REALTORS duties to NW Indiana Home Sellers

 REALTORS Duties to Clients and Customers is defined in the NAR Code of Ethics and Standards of Practice

The minimum standards of practice a consumer can expect when using the services of a REALTOR are clearly defined in the Code of Ethics of the National Association of REALTORS (NAR).

 

Some of the general public may not be aware of these rules which guide our decision making in choosing to do business with a prospective client or customer.

 

One example is #3 of 16  of our duties to clients and customers, it applies specifically to listing appointments : 

 

Standard of Practice 1-3 states:

    "REALTORS®, in attempting to secure a listing, shall not deliberately mislead the owner as to market value."  **




    Facts such as recent Multiple Listing Service SOLD comps in the market area of the home are presented to Northwest Indiana Home Sellers.

    Further data like visual inspection of the property condition and features by the REALTOR is needed to determine a price range for the homes LOCATION.

    If there is a huge discrepancy between the NW Indiana home sellers opinion of worth and the statistics, we ask to see a recent appraisal of their property.

    If there is none available, we suggest they obtain a Real Estate Appraisal by a licensed certified Appraiser, familiar with the market area, to provide a market value in writing.

Fireplace on that "Must Have" list when home buying? Here are some things to know about Fireplace Safety and Maintenance

Since a Fireplace is a frequently asked for "Must Have" on a home buyers wish list when we search and show them properties in Northwest Indiana, I've included a reprint from a recent article (February 2013) with some important safety and maintenance information written by a home inspector.*

Fireplace in home Fireplace Maintenance and Safety


A wood burning fireplace is an appealing feature of many homes. If you have not replaced your wood burning
fireplace with a gas or propane fueled one, there are precautions you should take to stay safe and warm, and to
maximize your enjoyment of a cozy fire.


Annual Inspections - Have your fireplace and chimney inspected and cleaned by a professional to ensure that it’s
obstruction free and clear of creosote – a black, oily substance that builds up on the inside walls of the chimney.
Because creosote is highly combustible, a thick accumulation creates a serious hazard that can put your home at risk
of a major fire.


Feeding Your Fire – Use dry, well­ seasoned hardwood in your fireplace. Avoid using pine and other oily woods, as
these will not burn cleanly. If you choose to use manufactured fire “logs”, do not burn them with real wood to avoid
the possibility of flare­ups.


Plan Ahead -­ Clear the area around the hearth of debris, decorations, and flammable materials. Use a metal mesh
screen that covers the opening, whether you have glass fireplace doors or not. Leave glass doors open while a fire is
burning to ensure good ventilation and airflow.


When to Clean ­- During periods of heavy use, clean the firebox regularly once the embers are cold. Leave about an
inch of ash because it acts as insulation, allowing the coals to heat faster and retain heat longer. Do not use a
vacuum to clean up fresh ashes, as embers can smolder for as long as several days after the fire is out, creating a
real fire hazard.


Upkeep ­- Check that vents are unobstructed and able to do their job. Clean the fan and all air circulation passages.
In non­ wood burning fireplaces, clean and adjust glowing embers and logs for best appearance.
Cap Your Chimney ­ Have a cap installed at the top of the chimney to deter animals from entering, help prevent
water damage and keep debris from blocking the opening. A spark arrestor will prevent live embers from escaping
the chimney and landing on nearby roofs.


Safety First ­ - Always keep a fire extinguisher on hand in case of emergency. Install smoke and carbon monoxide
detectors with charged batteries. 


Use Common Sense ­- Never leave the fire unattended. Make sure the fire is completely out before leaving the
house or going to bed, and keep children and pets away from the fireplace.


Be Community Aware – Many local ordinances prohibit the burning of wood, manufactured logs, or pellets on days
or nights when the amount of particulate matter in the air reaches a predetermined level.  Be sure to check with your
local air quality district or fire department before lighting your next fire.

It is a Violation of Indiana License Law for an Agent not to Appear at a Closing.

Indiana Real Estate Transactions in which licensed agents represent home Buyer(s) OR  home Seller(s) in a deal with

an accepted Purchase Agreement, MUST attend attend the closing of  the transaction!

This applies whether it is a relocation, new construction, short sale, REO, third party, or any type of listing, the agent needs to be at the closing.

 

It is The Law.                             Indiana Real estate Agents Must Attend Closings

 

You can verify if a Real Estate Agent or Broker is currently Licensed in Indiana by searching online at IN.Gov/PLA.

 The Indiana State Real Estate Commission has suspended licenses and put real estate agents/brokers on probation for not attending a closing.

 

It is a violation of Indiana Licensing Law for an Agent not to appear at a closing.

Northwest Indiana Property Tax Exemption Filing Deadline 12/31/12.

If you have not done so yet, you MUST re-file your home tax exemptions or your Property Tax bill will go up in 2013.

We at F.C.Tucker 1st Team Real Estate serving NW Indiana wanted to remind you that this is important because it helps to keep your property taxes lower!

 

The State of Indiana Homestead Verification Fact Sheet

details the Who? What? When? Where? and Why? questions homeowners may have and provides web links for additional information and resources.

 If you have filled and returned the pink or rose colored homestead verification form that was mailed with your property tax bills in 2010, 2011 and 2012, then your exemption should be on file with the County Auditors Office.

If you just purchased your Northwest Indiana Home this year and it is your principal residence,you may want to check online or call before 12/31/12 to verify your Homestead (and Mortgage) deduction is applied so your property tax obligation is lowered!
